Several States that have legalized same-sex marriages and/or registered partnerships have adopted conflict of law rules. Among the many issues of privateinternational law that may come into play, this chapter focuses on the law applicableto the formation of same-sex unions. If, indeed, we wish to understand whichcategories of same-sex couples are allowed to enter into a partnership or marriage,surely we need to look at the legislative policy of the individual countriesconcerned, whether they have chosen to adopt specific conflict rules or to applyprivate international law rules originally conceived for other legal institutions.
