A recent judgment re-examines the problem of proving the knowledge of the banking system of the insolvency of a reliable customer, in a bankruptcy revocatory of the remittances, according to the old text of art. 67. II l. fall., deciding that a repeated trust granted by the banks is an ignorance insolvency sign. The commentary addresses the main general difficulties in the early observation of the real debtor’s situation, the monitoring tools and the methods of analysis available to the various types of creditors.
