RIFLESSIONI SUI CONTROLLI ESPERIBILI NELL’ESPROPRIAZIONE IMMOBILIARE DELEGATA

The essay deals with some issues relating to the content and nature of the powers of delegated professionals in the context of the executive proceedings, as well as the controls available against delegated acts. The author's reflections, encouraged by a ruling from the Court of Cassation, also focus on the regime for stabilizing settlement operations if they are delegated to professionals, as well as the new regulations on the matter.

Il saggio affronta alcune questioni relative al contenuto e alla natura dei poteri esercitabili dai professionisti delegati nell'ambito del processo di espropriazione forzata, nonché ai controlli esperibili avverso gli atti delegati. Le riflessioni dell'autore, propiziate da una pronuncia della Corte di Cassazione, si focalizzano, altresì, sul regime di stabilizzazione delle operazioni liquidative, nell'ipotesi in cui le stesse siano delegate a professionisti, anche alla luce delle novità normative in materia.
