Art. 65 of the Industrial Property Code has been completely modified by the art. 3 of law no. 102 of 24 July 2023, which came into force last August 23rd. This reform responds to the many requests to modify the individual ownership of intellectual property rights on academic inventions, introduced in Italy by the law no. 383 of 18 October 2001. On closer inspection, however, the new discipline, inspired by the US model and by other European systems, appears to be based on a compromise solution between institutional and individual patent ownership over university inventions. The overcoming of some inconsistencies founded in the previous legislation is appreciated, but the recent changes made raise, in turn, quite a few perplexities concerning both basic and funded research, especially with reference to the need to consider all interests involved and to protect the inventors without hindering the dialogue between universities and businesses.
L’art. 65 del Codice della Proprietà industriale è stato radicalmente modificato dall’art. 3 della l. 24 luglio 2023, n. 102, entrata in vigore lo scorso 23 agosto. La riforma della normativa sulle invenzioni realizzate da ricercatori dipendenti di università e di enti pubblici di ricerca ha risposto alle molteplici istanze di superare la titolarità personale dei brevetti a favore degli inventori, introdotta con la l. 18 ottobre 2001, n. 383. La nuova disciplina, ispirata al modello statunitense e ad altri sistemi europei, a ben vedere si mostra fondata su una soluzione di compromesso tra titolarità istituzionale e personale. Si apprezza il superamento di alcune incongruenze della normativa previgente, ma le modifiche apportate sollevano, a loro volta, non poche perplessità che riguardano tanto la ricerca di base quanto quella finanziata, soprattutto con riferimento alla necessità di considerare tutti gli interessi coinvolti e di tutelare gli inventori senza ostacolare il trasferimento tecnologico.
