RINNOVI CONTRATTUALI E FORME DI PARTECIPAZIONE SINDACALE NEL LAVORO PUBBLICO

Contract renewals and forms of union participation in public work. – Summary. The Author critically examines the topic starting from the regulations of trade union participation in public administration and highlighting its specialty and restrictive character. It then analyzes collective bargaining, observing the changes from the 2016-2018 session, compliance with the regulatory provisions (non-interference in the management of the administration) and the effort to overcome the controversies of the past. After having noted special management participations in some sectors (schools and universities), the author concludes on the possible expansion of participation in a context characterized by the presence of stakeholders of active citizenship to avoid phenomena of collusion between unions, politics and bureaucracy and on a better arrangement between direct participation, which can develop as a consequence of organizational and digital innovations induced by the knowledge society, and indirect participation, especially in sectors where it is already visible.

L’Autore esamina criticamente le normative della partecipazione sindacale nell’amministrazione pubblica e rilevandone la specialità e il carattere restrittivo. Analizza poi la contrattazione collettiva, osservando le novità dalla tornata del 2016-2018, la conformità al dettato normativo (non interferenza nella gestione dell’amministrazione) e lo sforzo per superare le controversie del passato. Dopo aver constatato speciali partecipazioni gestionali in alcuni settori (Scuola e Università), l’autore conclude sul possibile ampliamento della partecipazione in un contesto caratterizzato dalla presenza di stakeholder di cittadinanza attiva per evitare fenomeni di collusione tra sindacati, politica e burocrazia e su una migliore sistemazione tra partecipazione diretta, che può svilupparsi in conseguenza delle innovazioni organizzative e digitali, indotte dalla società della conoscenza, e partecipazione indiretta, specie nei settori dove già è visibile.
