The constant concern of scence, is at all times – observes Spirito – the search for the conditions necessary to achieve maximum individual welfare and maximum social welfare. But almost all scientists avoid to face, or only summarily illustrate, the concept of individual well-being and social well-being, thus placing them-selves in the impossibility to give a scientifically rigorous answer. Therefore, once again it is necessary to reflect philosophically on the question, and to ask oneself with logical rigor what is meant by individual well-being, what is meant by so-cial well-being, and what is the relation-ship between the two types of well-being. The economist who is asked whether it is more convenient the regime of freedom and free competition or that of monopoly, responds that he can-not express a definitive opinion on the question, as he must limit himself to observing the trend of economic phenomena in the cases indicated, without decid-ing in favor of either of the two plans. This depends exclusively on the impossibility of calculating in total with exactitude all the pros and cons of the different hy-potheses. The philosophy of law has an important role to play in developing some essential concepts concerning man, both in his individual and collective sphere, in order to try to reach a solution of the complex economic–political and legal problem.
