The essay analyzes the role of ‘good moral’s, starting off with a historical evolutive outline of the debate which has taken place in literature and case-law, and comparing the French legal experience, which has recently been deeply re formed. The aim is to show that the Italian and French legal experiences follow different paths, and sketch out the current meaning and the opportunities of this general clause, intended as a persistent limit to party autonomy. The essay will seek to bridge the gap between the sociological approach and legal discourses grounded on the principles-values lexicon.
La riflessione si incentra sull’analisi del buon costume, partendo da un excur sus storico-evolutivo del dibattito emerso nella letteratura e nella casistica, in com parazione con l’esperienza giuridica francese, di recente oggetto di profonde mo difiche. L’obiettivo è mostrare la diversità di itinerari che connotano l’esperienza giuridica italiana e francese, e delineare il significato attuale e le potenzialità della evocata clausola generale, quale persistente limite all’autonomia negoziale, cer cando di mediare tra opzione sociologica e discorsi giuridici fondati sul lessico princípi-valori.
