The particular nature of industrial design has led to numerous debates on the most appropriate protection system. According to the legislation in force in Italy, result of the autonomy left to the Member States by Directive 98/71/EC, authorial protection is provided for these works only if there is artistic value, in addition to the creative character. The request for this additional requirement has led to multiple application difficulties, with obvious negative repercussions for legal certainty, that still remain, in part, after the important sentence of 2015, in which the Supreme Court indicated the importance of objective parameters. So, the Public Consultation launched by the European Commission in 2019 on the current legal framework for the protection of designs is very important to reflect again on the most adequate protection for industrial design, taking into account all the interests involved.
La peculiare natura delle opere dell’industrial design ha determinato numerosi dibattiti sul sistema di tutela preferibile e sull’opportunità di applicare la protezione autoriale. In base alla normativa vigente in Italia, risultato dell’autonomia lasciata agli Stati membri dalla Direttiva 98/71/CE, la tutela autoriale è prevista soltanto se in tali opere sia riscontrabile, oltre al carattere creativo, anche il valore artistico. La richiesta di tale requisito aggiuntivo ha determinato molteplici difficoltà applicative, con evidenti ripercussioni negative per la certezza del diritto, che in parte permangono anche dopo l’importante sentenza del 2015, nella quale la Cassazione ha indicato l’importanza dei parametri oggettivi. Di estrema utilità appare allora la Consultazione pubblica avviata dalla Commissione europea nel 2019 sull’attuale quadro normativo in materia di protezione di disegni e modelli, per tornare a riflettere sulla protezione più adeguata per le opere dell’industrial design, in considerazione di tutti gli interessi coinvolti.
