Il diritto del lavoro e le azioni di contrasto alle mafie

Abstract. The Labour Law and the Contrast to Mafias. The present paper relies on ‘axioms’ according to which confiscated mafia assets should be turned into common wealth – also for symbolic reasons – and which considers work a critical element to opposing organized crime. Work allows the fulfillment of individuals who are freed from need through the affirmation of their fundamental rights. The author sets out the Labour Law framework which allows (or rather, would allow) the enhancement of the relationship between work, law and employment policies and actions to fight mafias/ in contrast of mafias, with attention to the role played by social partners and political institutions. In this regard, the author highlights the importance of the quality, dignity, freedom and legality which are to characterize everybody’s work which should therefore never be considered “a commodity”. It is thus suggested that the neoliberal excesses economy be rejected and that a balance be found between the capabilities of the individuals and economic and productive assets.
