In Pago v Tirolmilch, the Court of Justice has given a preliminary ruling on the interpretation of Article 9(1)(c) of Council Regulation (EC) No. 40/94, about the protection guaranteed to a Community trade mark if it has a “reputation” only in one Member State. The case seems very relevant to clarify the conditions required to protect a trade mark with a reputation in the European Union.
