The work delves into some problems of interpretation and application of the phenomenon of the effect of extensive appeal (and the consequent decision), to which the law does not appear to be responding by providing solutions consistent with the normative data that adjusts an institute to which the doctrine and jurisprudence of the past have devoted particular attention ad that seems to be neglected by the legislature of 1988.

Il lavoro approfondisce alcuni problemi interpretativi ed applicativi del fenomeno dell'effetto estensivo dell'impugnazione (e della conseguente decisione), ai quali la giurisprudenza non pare rispondere fornendo delle ssoluzioni coerenti con i dati normativi che regolano un istituto a cui la dottrina e giurisprudenza, del passato, hanno, invece, dedicato particolare attenzione e che pare trascurato dal legislatore del 1988.
