The author, after showing the main changes introduced by Legislative Decree n° 23/2015 regarding unfair dismissals, doubts the com- patibility of the sanctions regime with EU law. The author dwells in particular on Article 30 of the Charter of Fundamental Rights of the European Union and on Article 24 of the Eu- ropean Social Charter (revised), analysed at EU law level by virtue of the reference contained in Article 151 TFEU. The doubts raised by the Author do not relate as much to the type of protection provided by the recent legislation in the event of (individual and collective) unju- sti ed dismissals, which is ‘essentially compen- satory’, but rather they relate to the technique used for calculating the damages that is focused on the sole criterion of ‘seniority’
